Klimaschutz als kommunale Pflichtaufgabe!

The article argues that climate protection and climate adaptation should be transferred to the stock of mandatory municipal tasks – even if this requires clarification of various constitutional and legal issues. The political urgency to sustainably mitigate climate change at all federal levels in Germany requires that questions of the functional distribution of responsibilities, in which the legal institute of local self-government autonomy functions as a constitutionally guaranteed barrier to competence, be put aside. Instead, there is a need for strengthening the responsibilities of the municipalities that is oriented toward the goals and practical requirements for action in climate protection and climate adaptation, without granting them any kind of status under natural law.
